Beyond identical wording, the issue concerned the relationship between goods
The dispute concerned trademark No. 45302035, “优瞳”, for Class 5 goods including care solutions and eye drops. The earlier “优瞳” mark covered Class 9 goods including contact lenses. With identical wording in different classes, the relationship between the goods became a central issue.
Placing two products in different entries of a classification table does not explain how they are bought, used and sold. Liangma’s trademark team examined commercial practice: the role of care products when using contact lenses, how brands bundle products and the channels through which consumers encounter them.
Use product bundles to give commercial relationships a concrete form
The team reviewed relevant judicial reasoning, then organised materials around function and purpose, complementary use, sales channels and consumers. Compared with an abstract statement that goods are related, pages identifying products, marks, dates and sales arrangements bring the argument into an actual transaction setting.
Evidence included “contact lenses + care solution” bundles from eye-health brand stores. These materials illustrated product combinations and brand operations as comparative evidence for the argument. Their role was to show how evidence was selected and connected to the issue; the comparison brands were not presented as Liangma clients.
Three perspectives explain why the goods may be understood as related
Function and purpose explain how the products work together; the use process explains why consumers encounter them together; channels and consumers place that connection in the buying setting. The team connected these perspectives so the goods relationship could be discussed through individual facts.
A bundle sales page is not a standalone conclusion. It must be read with the disputed mark, designated goods and other transaction materials. This also preserves the case boundary: the issue concerned specific contact-lens and care products, and does not replace analysis of other industries or product combinations.
Apply the experience to brand planning for related products
Brands selling core products and accessories can organise records as core products already sold, accessories already sold and products planned for expansion. For each group, link the marks, designated goods, packaging, website or store pages and actual bundle records, distinguishing existing transactions from future plans.
These materials support two different discussions: goods lists and filing strategies while the business expands, or available evidence and administrative or litigation work after a dispute arises. Liangma defines the scope against the brand’s current stage so planning and dispute work share the same product facts.
